Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not access or use our platform.
1. Introduction
1.1 Welcome to acadRight. These Terms and Conditions (“Terms”) govern your access to and use of acadRight’s website, services, and related offerings (collectively, the “Platform”). By using the Platform or submitting an enquiry, you agree to be bound by these Terms.
1.2 These Terms form a legally binding contract between you and acadRight. If you do not agree, do not use the Platform.
1.3 acadRight is a brand owned and operated by DARC Advance Learning Private Limited, registered under the Companies Act, 2013.
2. Applicable Law & Electronic Records
2.1 These Terms are an electronic record under applicable law and do not require any physical signature.
2.2 These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
3. Eligibility
3.1 The Platform is intended for adults who can form legally binding contracts. If you are under 18, a parent or guardian must accept these Terms on your behalf.
3.2 acadRight may refuse service or change eligibility criteria at its sole discretion.
4. Definitions
Programme: any online degree or professional programme offered by a University Partner and promoted on the Platform.
University Partner: a university or institution tied up with acadRight to offer Programs (currently Manipal University, UPES Dehradun, and LPU).
User: any person accessing the Platform, whether or not they submit an enquiry.
Applicant: a User who submits an enquiry or application for a Programme through the Platform.
5. Platform Scope & Service Nature
5.1 acadRight is an admissions counselling and enrolment-assistance platform for its University Partners. acadRight itself is not a university. We help working professionals discover, compare, and enrol in online degree Programs offered by our University Partners.
5.2 Programme content, curriculum, fees, and delivery are determined solely by the respective University Partner and may be updated, modified, rescheduled, or changed at that University Partner’s discretion.
5.3 acadRight does not itself deliver academic content, conduct examinations, or teach any Programme; these are the sole responsibility of the University Partner.
5.4 Degrees, diplomas and other qualifications awarded upon successful completion of a Programme are issued by the respective University Partner, not by acadRight, in accordance with that University Partner’s UGC-DEB entitlement, NAAC accreditation, and other applicable regulatory approvals current at the time of your admission. acadRight’s role is limited to counselling, comparison information, and enrolment assistance.
6. Registration, Accounts & Security
6.1 To access certain features or submit an enquiry, you must provide accurate information and keep it up to date.
6.2 You are responsible for safeguarding any account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
6.3 acadRight may suspend or terminate accounts for false information, violation of these Terms, or suspicious activity.
7. User Conduct
7.1 Users must comply with applicable laws and refrain from posting illegal, defamatory, infringing, abusive, or otherwise prohibited content.
7.2 Impersonation, harassment, and interference with the Platform’s operation are prohibited.
7.3 acadRight reserves the right to remove content and suspend or terminate accounts that violate these rules, and to report unlawful activity to law enforcement.
8. User Content & Licences
8.1 You retain ownership of any content you submit to us (e.g. enquiry details, feedback), but grant acadRight a licence to use it for operating and improving the Platform and for coordinating your enquiry with a University Partner.
8.2 You warrant that you have the necessary rights to any content you submit and that it does not infringe third-party rights.
9. Programme Fees & Payments
9.1 Programme fees, applicable taxes, and payment schedules are determined and displayed by the respective University Partner at the time of admission. acadRight does not set or alter these fees.
9.2 Payments for programme fees are made directly to the University Partner or through payment mechanisms designated by that University Partner. acadRight does not collect or hold programme fees on your behalf.
9.3 You are responsible for all fees and taxes associated with your enrolment. Where financing, EMI, or partner payment options are offered by a University Partner, those third parties set their own terms.
10. Refunds & Cancellations
10.1 Refund and cancellation terms for programme fees are governed by the respective University Partner’s own refund policy, which will be shared with you at the time of admission or is available on that University Partner’s official website.
10.2 acadRight will assist in coordinating refund or cancellation requests with the University Partner on your behalf, but does not itself determine or process tuition refunds, since it does not collect programme fees directly.
11. Counselling Calls & Communication
11.1 Counselling calls, webinars, or informational sessions conducted directly by acadRight may be recorded for quality, training, or promotional purposes. By participating, you consent to such recording.
11.2 Live academic classes delivered as part of a Programme, and any recording of them, are governed by the respective University Partner’s own policies — not by acadRight.
12. Certification & Outcomes
12.1 Certificates, degrees, or credentials are issued solely by the respective University Partner upon your successful completion of that University Partner’s own completion criteria — not by acadRight.
12.2 Enrolling in a Programme through acadRight does not guarantee admission, employment, salary increase, or any particular career outcome.
13. Intellectual Property
13.1 All acadRight platform IP — branding, website design, source code, counselling materials, and comparison data — is the exclusive property of acadRight or its licensors. Course content, curriculum, and academic materials remain the intellectual property of the respective University Partner.
13.2 Unauthorised reproduction, distribution, or creation of derivative works from acadRight’s platform IP is prohibited.
14. Third-Party Links & Services
14.1 The Platform may link to University Partner websites or other third-party services. acadRight is not responsible for third-party services, and their own terms apply once you leave our Platform.
15. Data, Privacy & Consent
15.1 acadRight’s Privacy Policy governs the collection and use of your personal data, including sharing it with a University Partner when you enquire about their Programme. By using the Platform, you consent to this.
15.2 acadRight complies with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable data protection laws regarding processing, storage, consent, and erasure of personal data.
16. Limitation of Liability
16.1 The Platform is provided “as is”. acadRight disclaims all warranties to the fullest extent permitted by law, including as to accuracy of programme information or uninterrupted operation.
16.2 acadRight is not liable for indirect, incidental, or consequential damages, nor for any act, omission, or academic decision of a University Partner, which operates independently of acadRight.
17. Indemnification
17.1 You agree to indemnify and hold acadRight harmless from claims, losses, or damages arising from your breach of these Terms or your misuse of the Platform.
18. Termination
18.1 acadRight may suspend or terminate your access to the Platform for breach of these Terms, illegal activity, or misuse.
19. Copyright Procedure
19.1 If you believe content on the Platform infringes your intellectual property rights, submit a takedown notice to our Copyright Agent at legal@acadright.com with subject line “Copyright Infringement Notice”.
19.2 A valid notice must include: a signature of the authorised person, identification of the copyrighted work, identification of the infringing material’s location on the Platform, your contact details, and good-faith and accuracy statements. We will review and act on complete notices within 10–15 working days.
20. Force Majeure
20.1 acadRight is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, internet outages, or government actions.
21. Amendments
21.1 acadRight may modify these Terms by posting the updated version on the Platform. Continued use after changes constitutes acceptance. Material changes will be communicated via email or in-product notice where practicable.
22. Miscellaneous
22.1 Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and acadRight.
22.2 Severability: Invalid or unenforceable provisions shall be severed without affecting the rest.
22.3 No waiver: Failure to exercise any right is not a waiver of that right.
